Terms & Conditions Rental Agreement
 

This Rental Agreement (“Agreement”) is entered into by and between Owner, Guest, and REMAX Realty Group, acting as Agent (“Agent”). In consideration of the rent received and the mutual promises contained herein, Owner, through Agent, agrees to lease the Property described above to Guest under the following terms and conditions.
1) Automatic Payments / Agreement
The initial fifty percent (50%) of the rental rate shown on page one of this Agreement has been charged to the credit card on file. Guest acknowledged and agreed to the applicable terms and conditions at the time of booking; however, an executed Agreement reflecting those terms and conditions, and any required community or HOA addendums, is mandatory.
The remaining balance will be automatically charged to the same credit card on file thirty (30) days prior to arrival. A reminder email will be sent in advance of the scheduled charge. If a reservation is made within thirty (30) days of the check-in date, payment in full is due at the time of booking.
If the balance is not received within the required time frame, Agent reserves the right to deem the reservation canceled, and all monies paid shall be forfeited unless the reservation dates are successfully re-rented.
All funds are processed through Agent’s rental escrow account, and any interest accrued thereon shall be retained by Agent. Any VRBO service fees will appear as separate line items on the Guest’s credit card statement and are non-refundable. The $249.99 processing fee is also non-refundable in the event of cancellation.
2) Travel Insurance / Cancellation Policy
Travel insurance is strongly recommended, and Agent offers this option for your convenience. The applicable cancellation policy is outlined in No. 2 of the Agreement. Please note that the VRBO service fee is non-refundable in the event of cancellation.
3) Damages and Excessive Cleaning
Guest acknowledges that protection against accidental damage has been added to the reservation. Guest agrees that any cleaning, repairs, replacements, or remediation required as a result of Guest’s use of the Property, beyond normal wear and tear, shall be the financial responsibility of the Guest. If the cost of such damage exceeds the amount of the damage protection or triggers the $2500 deductible for real property damage, Guest hereby authorizes Broker to deduct the remaining balance from the refundable security deposit, if applicable, and/or charge the credit card on file without additional authorization, as permitted by law. Charges may be processed after checkout following inspection and documentation of the Property and may include applicable administrative fees.
4) Risks / Waiver of Liability
Guest assumes all risks associated with the use and occupancy of the Property and any amenities. Guest acknowledges and agrees that there are inherent risks associated with the use of any rental property, including but not limited to spas, hot tubs, saunas, Jacuzzis, pools, decks, stairs, elevators, and outdoor areas.
Guest represents that they are familiar with, and agree to use, the Property and all amenities in a safe and responsible manner. Guest shall be responsible for instructing all occupants, invitees, and visitors on the proper and safe use of the Property and its amenities.
To the fullest extent permitted by law, Guest agrees to defend, indemnify, and hold harmless Owner and Agent, and their respective agents, employees, and representatives, from and against any and all claims, demands, damages, losses, liabilities, costs, or expenses, including reasonable attorneys’ fees and legal costs, arising out of or related to Guest’s use or occupancy of the Property, or the acts or omissions of Guest or Guest’s occupants, invitees, licensees, or visitors, including minors, except to the extent caused by the sole negligence of Owner.
Guest further agrees to be responsible and liable for, and shall reimburse Owner or Agent upon demand for, any damage to the Property or its contents caused by the misuse, negligence, or intentional acts of Guest or Guest’s occupants, invitees, or visitors.
5) Pets / Smoking
Pets are not permitted in the Property unless expressly authorized in this Agreement, excluding service animals as defined by the Americans with Disabilities Act (ADA). For pet-friendly properties, a non-refundable pet fee per pet is required, along with an executed Pet Addendum. The pet fee is non-refundable even if Guest elects not to bring the pet.
Smoking is strictly prohibited inside the Property, including balconies, porches, and other attached structures. Smoking is permitted only in designated outdoor areas where allowed by applicable municipal, community, or association rules.
Any violation of this Pets and Smoking policy shall constitute a material breach of this Agreement and may result in immediate eviction, forfeiture of all monies paid, and Guest’s responsibility for any additional cleaning, deodorization, damage, or extermination fees incurred. 6) Occupancy / Special Events
Occupancy limits are established in accordance with Owner, Town, County, and State statutes, regulations, and ordinances. Overcrowding, group occupancy, misrepresentation, or subletting are grounds for immediate eviction and forfeiture of all monies paid.
Guest acknowledges that they are at least twenty-five (25) years of age, must occupy the Property for the entire rental period, and are responsible for the conduct of all occupants. Owner does not permit group rentals, special event reservations, parties, gatherings, or reservations deemed high-risk. Any violation of this policy may result in immediate termination of the reservation without refund.
7) Agent’s Right of Entry
In an emergency, Agent may enter the Property at any time without notice. This will only be exercised for extreme circumstances.
8) Property Furnishings / Condition
The Property is privately owned and maintained and reflects the personal taste of the Owner. Guests are encouraged to visit the Property prior to making a legally binding commitment to ensure it meets their expectations. Every effort has been made to ensure the accuracy of information provided; however, Agent is not responsible for changes in furnishings, bedding, printing errors, or equipment failures.
The Property is furnished with essential housekeeping items, dishes, cookware, flatware, pots and pans, small appliances, and similar items. Rearrangement of furniture is prohibited, and a $150.00 fee will apply if furniture is moved and not returned to its original location. All equipment should be in working order; any inoperable items must be reported upon arrival. Every effort will be made to expedite repairs through the Owner and service providers.
If the Property offers a grill, Guests are responsible for keeping it clean and ensuring it is filled with propane. Majority of Properties do not supply paper products or linens. Check the listing carefully for more details. 
9) Refunds / Force Majeure
Guest acknowledges that no refunds are owed for inoperable appliances, community amenities, beach replenishment, community construction, delayed access, cleaning concerns, or similar issues. Agent and Owner will make every effort to ensure Guest enjoys their stay and to take corrective measures.
Unforeseeable circumstances, including but not limited to fire, flooding, equipment failure, or other casualty at the Property, may make it impossible for Agent to honor accommodations. In such cases, Agent will make reasonable efforts to relocate Guest to a comparable property; however, alternative housing is not guaranteed. If relocation is not possible, Agent shall refund Guest for accommodations not honored.
10) Check-In / Cleaning
Check-in is after 3:00 PM. Cleaners or maintenance vendors may remain at the Property until 5:00 PM, which could delay access. Guests may not enter or park at the Property before 3:00 PM.
Any damage, cleaning concerns, or discrepancies must be reported within 48 hours of check-in. Turn-over cleans are surface-level only; deep cleans are performed seasonally in the spring. Agent will address reported cleaning concerns to the extent possible during Guest’s stay.
11) Check-Out / Amenities Passes
Check-out is any time before 10:00 AM and includes the use of amenities and parking at the Property until that time. Owner and/or an assigned inspector may access the Property after occupancy. Any damages not reported at check-in or during occupancy will be assumed to have been caused by Guest, and damages must be reported immediately.
Check-out procedures are provided via a QR code or welcome binder. Guest is responsible for leaving the Property in the same condition in which it was found. Any amenity passes provided must be returned to their original location. Replacement costs for lost or damaged items may exceed $300. Guest is expected to treat all Property items and amenities with care.
12) Right to Evict
Our goal is to help ensure Guest has a pleasant stay; however, Agent must also ensure that the Property is protected and that peace is maintained within the community. Agent reserves the right to evict Guest without refund
13) Acknowledgment
By signing below, Guest acknowledges they are at least 18 years of age and have the legal capacity to enter into this Agreement. Notwithstanding any assurance to the contrary, this Agreement is not legally binding or effective until signed by Guest and received by Agent, along with any necessary supporting documents and the balance due. At any time prior thereto, this offer to rent may be withdrawn by Agent without notice.
Guest has read, understands, and agrees to the above terms and policies. Guest further authorizes that any damages or excessive cleaning fees not covered by damage insurance or a refundable security deposit will be charged to the card on file.
